General Terms
This website (the “Site”) and all home health and home care services are owned and operated by Living Care Home Services (“LCHS,” “Company,” “we,” or “us”). By engaging our services or using the Site, you (“Client,” “Patient,” “Authorized Representative,” or “User”) agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that may apply to specific services.
Accessing the Site in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms.
We reserve the right to change these Terms of Service or to impose new conditions from time to time. By continuing to use the Site or our services after we post any such changes, you accept the revised Terms.
1. Services Provided
Living Care Home Services provides home health and personal care services including, but not limited to: skilled nursing care, physical therapy, occupational therapy, speech therapy, medical social services, home health aide services, companionship, assistance with activities of daily living (ADLs), and post-operative care coordination.
Specific services authorized for each client will be outlined in the individualized Plan of Care (POC) developed in cooperation with the client, their physician, and applicable healthcare providers. Services are delivered in accordance with applicable federal, state, and local laws and regulations governing home health and home care agencies.
2. Eligibility and Intake
To receive services from Living Care Home Services, clients must:
- Complete an intake assessment conducted by a qualified LCHS representative
- Provide accurate and complete medical, personal, and insurance information
- Obtain and maintain a physician’s order or referral where required by applicable law or payer source
- Execute all required admission agreements, consents, and HIPAA authorizations
LCHS reserves the right to decline or discontinue services if a safe and appropriate care environment cannot be established, or if the requested services fall outside our scope of licensure or competency.
3. Plan of Care and Authorization
All care services are delivered pursuant to a written Plan of Care (POC) authorized by the client’s attending physician or licensed practitioner, reviewed and updated periodically or upon a significant change in the client’s condition. Clients or their authorized representatives have the right to participate in the development and revision of their POC and may request changes at any time.
4. Client Rights and Responsibilities
Client Rights
All clients have the right to:
- Be treated with dignity, respect, and compassion, regardless of race, religion, gender, age, disability, or any other protected characteristic
- Receive care that is appropriate, effective, and consistent with their individualized Plan of Care
- Be fully informed of their diagnosis, treatment options, and expected outcomes in a language or format they can understand
- Participate in decisions about their care, including the right to refuse treatment
- Have their personal, financial, and medical information kept strictly confidential
- Voice grievances and complaints without fear of retaliation or discrimination
- Receive advance notice of any significant changes to their care schedule or assigned caregiver
- Know the name, qualifications, and role of each caregiver providing services
Client Responsibilities
Clients agree to:
- Provide accurate and complete information about their health status, medical history, and home environment
- Inform LCHS of any changes in their health condition or care needs
- Treat LCHS caregivers and staff with courtesy and respect
- Maintain a safe working environment for caregivers, including adequate lighting and accessible equipment
- Notify LCHS at least 24 hours in advance of schedule changes or service cancellations where possible
- Fulfill financial obligations in a timely manner in accordance with the agreed payment terms
5. Scheduling, Cancellations, and Changes
LCHS will make every reasonable effort to maintain consistent caregiver assignments; however, we cannot guarantee the same caregiver for every visit. Clients are requested to provide a minimum of 24 hours advance notice for cancellations or rescheduling. Repeated late cancellations or no-shows may affect service availability and may be subject to fees as outlined in the Service Agreement.
LCHS reserves the right to reschedule or temporarily suspend services due to caregiver illness, inclement weather, public health emergencies, or other circumstances beyond our control, with reasonable notice provided.
6. Fees, Billing, and Payment
Fees for services are established in the individualized Service Agreement. LCHS will submit claims to authorized payers on behalf of the client where applicable. The client or authorized representative is responsible for any balances not covered by insurance, including co-pays, deductibles, and non-covered services.
Payment is due within 30 days of the invoice date unless otherwise specified. LCHS reserves the right to suspend services for significantly past-due accounts with advance notice. Billing inquiries should be directed to info@livingcarehomeservices.com or 215-348-4008.
7. HIPAA Compliance & Confidentiality
Living Care Home Services is fully committed to protecting the privacy and confidentiality of all client health information in accordance with HIPAA and all applicable state privacy laws. We use and disclose Protected Health Information (PHI) only as permitted or required by law. A Notice of Privacy Practices (NPP) is provided at admission and available upon request.
We will not sell or use your personal or health information for marketing purposes without your explicit written consent. Please refer to our Privacy Policy for full details.
8. Intellectual Property Rights
Our Limited License to You
This Site and all materials available on it are the property of Living Care Home Services and/or our affiliates or licensors, protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use.
You may not modify, copy, reproduce, republish, upload, post, transmit, sell, create derivative works, or exploit any material from the Site without authorization. You may download or print one copy of individual pages for personal, non-commercial use, provided all copyright notices remain intact.
Your License to Us
By submitting any material to us via the Site or other digital channels, you represent that you own or have obtained all necessary rights to that material, and you grant LCHS a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, distribute, and publicly display such material for legitimate business purposes.
9. SMS Messaging Terms & Compliance
Program Description
LCHS’s SMS messaging program sends appointment confirmations, reminders, care coordination updates, and customer support communications to clients who have explicitly opted in to receive SMS notifications via our intake forms or scheduling systems.
Cancellation Instructions
You can cancel SMS service at any time by replying “STOP” to any message we send. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. No further messages will be sent unless you re-opt in.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message & Data Rates
Standard message and data rates may apply for messages sent to or from you. Message frequency varies based on your service schedule and care needs. For questions about your text or data plan, contact your wireless provider.
Supported Carriers
Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
Age Restriction
You must be 18 years or older to participate in our SMS program.
Privacy
For privacy-related inquiries regarding SMS, please refer to our Privacy Policy. We comply with all applicable laws including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
10. Disclaimers
Throughout the Site, we may provide links and pointers to third-party websites. Our linking to such sites does not imply endorsement or sponsorship of those sites or the products and services offered through them.
The information, products, and services offered on or through the Site are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible by applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.
You agree to indemnify and hold harmless Living Care Home Services, its affiliates, and their respective officers, directors, agents, and employees from any claims, damages, liabilities, costs, and expenses arising out of your breach of any obligation, warranty, or representation under these Terms.
11. Nondiscrimination Policy
Living Care Home Services is committed to providing quality home health and home care services to all individuals without discrimination. We do not exclude, deny benefits to, or otherwise discriminate against any person on the basis of race, color, national origin, ancestry, religion, sex, sexual orientation, gender identity or expression, age, disability, marital status, veteran status, genetic information, or any other characteristic protected by applicable federal, state, or local law.
This policy applies to all programs, services, activities, admissions, referrals, hiring, and employment practices of Living Care Home Services.
12. Equal Access to Care
We provide equal access to care and services and make reasonable accommodations for individuals with disabilities, including:
- Providing auxiliary aids and services when appropriate
- Offering language assistance services, free of charge, for individuals with limited English proficiency

13. Reporting Concerns
Any individual who believes they have been subjected to discrimination, unequal treatment, or any violation of their client rights is encouraged to contact us promptly. Concerns may be submitted by:

All complaints will be reviewed and investigated by our compliance team. Retaliation against any individual who files a good-faith complaint is strictly prohibited. Clients also have the right to contact the Pennsylvania Department of Health or the U.S. Department of Health and Human Services Office for Civil Rights.
14. Limitation of Liability
Living Care Home Services shall not be held liable for any delays, interruptions, or failure to deliver services resulting from events beyond our reasonable control, including natural disasters, public health emergencies, governmental actions, or labor disruptions. To the maximum extent permitted by applicable law, LCHS’s total liability for any claims shall not exceed the total fees paid by the client for services in the three (3) months preceding the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud.
15. Termination
We reserve the right to terminate or suspend your access to our services, without notice, if we determine you have violated these Terms or engaged in conduct we deem inappropriate or unlawful. LCHS will provide no less than 10 business days advance notice of service termination except where the client’s behavior poses a safety risk, continued services would violate applicable law, or the client fails to maintain financial obligations after reasonable notice. Upon termination, LCHS will assist with care transition planning to minimize disruption to the client’s health and safety.
16. Registration & Passwords
To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized use of your account, notify us immediately at info@livingcarehomeservices.com. We are not liable for any loss or damage arising from your failure to maintain account security.
17. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute arising under these Terms shall first be subject to good-faith mediation. If mediation does not resolve the dispute, the parties agree to binding arbitration in Bucks County, Pennsylvania, in accordance with the American Arbitration Association’s rules.
18. Changes to Terms of Service
We may update these Terms of Service from time to time. The latest version will always be available on our website with the updated effective date. For material changes, active clients will receive reasonable advance notice. Continued use of our services constitutes acceptance of the revised Terms.
